These Terms and Conditions ("Terms") govern your access to and use of the Atlas Adjusting website located at atlasadjusting.co (the "Site") and any related services provided by Atlas Adjusting ("we," "our," or "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Site or services.

1. Services Provided

Atlas Adjusting operates as a licensed Public Adjusting firm in the States of Arizona (Lic. #20567702), Nevada (Lic. #4008093), Nebraska (Lic. #20567702), and Oklahoma (Lic. #3003654766). We advocate strictly for the policyholder in property insurance claims. Please note:

• Information provided on this Site, including the Claim Calculator, is for estimated and informational purposes only and does not guarantee a specific settlement amount.
• Submission of a contact form or request for a "Free Consultation" does not establish a formal client-adjuster relationship.
• A binding relationship is only formed upon the execution of a written Public Adjuster Representation Agreement signed by both parties.

2. No Legal Advice

While we are experts in insurance policies, property damage assessment, and claim negotiation, we are not attorneys. The content on this Site and any advice given by our adjusters is strictly related to public adjusting and insurance claim processing. It should not be construed as legal advice. If you require legal representation, we recommend consulting a licensed attorney.

3. Fees and Contracts

Our adjusting services are offered on a "No Recovery, No Fee" contingency basis. This means we do not charge upfront fees for our representation. Our compensation is based on a pre-agreed percentage of the final insurance settlement, which will be explicitly detailed in your Representation Agreement in compliance with applicable state law.

4. SMS & Communications Terms

By submitting your phone number via our forms, you explicitly consent to receive calls and SMS/text messages from Atlas Adjusting regarding your inquiry, claim status, or appointments. Please be aware of the following regarding our SMS communications:

• Opt-Out: You may cancel the SMS service at any time. Simply reply "STOP" to any of our messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS, and you will no longer receive SMS messages from us.
• Help: If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance, or contact us directly at [email protected].
• Rates: Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on the status of your claim.
• Limitation of Liability: Carriers are not liable for delayed or undelivered messages.
• User Requirements: By subscribing, you confirm that you are over the age of 18 and authorized to provide the phone number submitted.
• Privacy: We will never sell or share your mobile data with third parties for marketing purposes. Please refer to our Privacy Policy for more details.

5. Intellectual Property

Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us and are protected by copyright and trademark laws.

6. Governing Law and Jurisdiction

These Terms shall be governed by and defined following the laws of the State of Arizona, United States. Atlas Adjusting and yourself irrevocably consent that the courts of Maricopa County, Arizona shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
